In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the (...) work, noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. Soren Kierkegaard’s Lutheran existentialism represents a distinctively postmetaphysical philosophy of religion, focused in particular on a Christian vision of ethical authenticity. The popular subject of near‐death experiences (NDEs) occupies a potentially crucial place in scholarly discussions of topics such as human nature and the possibility of an afterlife. This chapter investigates primarily one key subject: the topic of whether NDE observations provide any potential evidence for the existence of a conscious human self during a ND state, such as when neither the heart nor the brain register any known activity. Increasingly, the most evidential NDE cases are usually thought to occur especially (...) when the corroboration is produced during a state of cardiac arrest due to ventricular fibrillation. Yet, Michael Marsh is immensely impressed with the real transformations that seem to affect ND experiencers (NDErs). Alternative rejoinders no longer seem to have truly made as many gains in the most recent conversations, including Marsh's own hypothesis of a waking brain. (shrink)

We propose that emotion psychology would significantly gain from including narrative(s) and the conversational negotiation of appropriateness. Using the example of anger, we argue that narrators need to construct plausible narratives of emotional events to achieve validating responses by listeners. We argue first that narrators attempt to demonstrate that the appraisal conditions for their emotion are given so that the emotion fits the narrated events. Second, we argue that this in turn explains why narratives of specific emotions exhibit specific forms. (...) Third, we argue that coping with emotional experiences is helped by narrating such that the fittingness of emotions is demonstrated. We conclude that narrative plays an important role for identifying, processing, communicating, and eliciting emotions. (shrink)

Jurgen Habermas's program in formal pragmatics fulfills two main functions.

Here, for the first time in English, is volume one of Jurgen Habermas's long-awaited magnum opus: The Theory of Communicative Action. This pathbreaking work is guided by three interrelated concerns: to develop a concept of communicative rationality that is no longer tied to the subjective and individualistic premises of modern social and political theory; to construct a two-level concept of society that integrates the 'lifeworld' and 'system' paradigms; and to sketch out a critical theory of modernity that explains its (...) sociopathologies in a new way. Habermas approaches these tasks through a combination of conceptual analyses, systematic reflections, and critical reconstructions of such predecessors as Marx and Weber, Durkheim and Mead, Horkheimer and Adorno, Schutz and Parsons. Reason and the Rationalization of Society develops a sociological theory of action that stresses not its means-ends or teleological aspect, but the need to coordinate action socially via communication. In the introductory chapter Habermas sets out a powerful series of arguments on such foundational issues as cultural and historical relativism, the methodology of Verstehen, the inseparabilty of interpretation from critique. In addition to clarifying the normative foundations of critical social inquiry, this sets the stage for a systematic appropriation of Weber's theory of rationalization and its Marxist reception by Lukacs, Horkheimer and Adorno. This article contains reflections on the further structural transformation of the public sphere, building on the author’s widely-discussed social-historical study, The Structural Transformation of the Public Sphere, which originally appeared in German in 1962 (English translation 1989). The first three sections contain preliminary theoretical reflections on the relationship between normative and empirical theory, the deliberative understanding of democracy, and the demanding preconditions of the stability of democratic societies under conditions of capitalism. The fourth section turns to the implications of digitalisation (...) for the account of the role of the media in the public sphere developed in the original work, specifically to how it is leading to the expansion and fragmentation of the public sphere and is turning all participants into potential authors. The following section presents empirical data from German studies which shows that the rapid expansion of digital media is leading to a marked diminution of the role of the classical print media. The article concludes with observations on the threats that these developments pose for the traditional role of the public sphere in discursive opinion and will formation in democracies. (shrink)

Two countervailing trends mark the intellectual tenor of our age the spread of naturalistic worldviews and religious orthodoxies. Advances in biogenetics, brain research, and robotics are clearing the way for the penetration of an objective scientific self-understanding of persons into everyday life. For philosophy, this trend is associated with the challenge of scientific naturalism. At the same time, we are witnessing an unexpected revitalization of religious traditions and the politicization of religious communities across the world. From a philosophical perspective, this (...) revival of religious energies poses the challenge of a fundamentalist critique of the principles underlying the modern Wests postmetaphysical understanding of itself. The tension between naturalism and religion is the central theme of this major new book by Jrgen Habermas. On the one hand he argues for an appropriate naturalistic understanding of cultural evolution that does justice to the normative character of the human mind. On the other hand, he calls for an appropriate interpretation of the secularizing effects of a process of social and cultural rationalization increasingly denounced by the champions of religious orthodoxies as a historical development peculiar to the West. These reflections on the enduring importance of religion and the limits of secularism under conditions of postmetaphysical reason set the scene for an extended treatment the political significance of religious tolerance and for a fresh contribution to current debates on cosmopolitanism and a constitution for international society. An account of the emergence and disintegration of.

With a philosopher like Martin Seel, reflecting this closely on the literary form in which to present his ideas, it is not surprising that philosophy of language makes for a focus of interest. Since my own interest also points in this direction, I will start with Seel’s groundbreaking essay on literal and figurative speech (I). I will then deal with the concept of ›letting oneself be determined‹ as the pivotal point of Martin Seel’s philosophy (II). The resulting pragmatist understanding of (...) sociocultural forms of life has important consequences for the way in which Seel detranscendentalizes Kant’s epistemology (III). Finally, I will critically examine the conception of a practical philosophy developing aesthetics and morality out of the fundamental question of ethics (IV). In this conception, a self-image of philosophy oriented towards the unity of the true, the good and the beautiful. In my opinion, however, Martin Seel neglects history as a dimension in which reason leaves its traces (V). (shrink)

In this, the second of two articles outlining a theory of communicative competence, the author questions the ability of Chomsky's account of linguistic competence to fulfil the requirements of such a theory. ?Linguistic competence? for Chomsky means the mastery of an abstract system of rules, based on an innate language apparatus. The model by which communication is understood on this account contains three implicit assumptions, here called ?monologism?, ?a priorism?, and ?elementarism?. The author offers an outline of a theory of (...) communicative competence that is based on the negations of these assumptions. In opposing the first two assumptions he introduces distinctions, respectively, between semantic universals which process experiences and those that make such processing possible, and between semantic universals which precede all socialization and those that are linked to the conditions of potential socialization. Against elementarism, he argues that the semantic content of all possible natural languages does not consist of combinations of a finite number of meaning components. Differences in systems of classification preclude this, and such differences can be seen to infect all respects of intercultural comparison. Using the notion of ?performative utterance?, the author elucidates the role of dialogue?constitutive universals as part of the formal apparatus required of a?; speaker's capacity to communicate. He then notes what would be required of a general semantics based on a theory of communicative competence; and finally points out how this theory might be used for social analysis. (shrink)
